Can a creditor run your credit report?
Judgment creditors trying to collect a debt based on a credit transaction involving a regular creditor can look at credit reports to decide whether to begin collection efforts against you. They can also use reports to locate you or your assets.
Now, the good news is that lenders can't just access your credit report without your consent. The Fair Credit Reporting Act states that only businesses with a legitimate reason to check your credit report can do so, and generally, you have to consent in writing to having your credit report pulled.
Current or potential creditors β like credit card issuers, auto lenders and mortgage lenders β can pull your credit score and report to determine creditworthiness as well. Credit history is a major factor in determining (a) whether to give you a loan or credit card, and (b) the terms of that loan or credit card.
However, the Fair Credit Reporting Act also states that debt collection agencies are permitted to access your personal credit report. They are able to do this in order to confirm that they have accurate contact information for you, and to assess how likely you are to pay off a given debt.
While the general public can't see your credit report, some groups have legal access to that personal information. Those groups include lenders, creditors, landlords, employers, insurance companies, government agencies and utility providers.
Can you sue for unauthorized credit inquiries? You do have the right to sue for willful violation of the Fair Credit Reporting Act (FCRA). You should consult with an attorney if you are considering this route.
Debt collectors cannot harass or abuse you. They cannot swear, threaten to illegally harm you or your property, threaten you with illegal actions, or falsely threaten you with actions they do not intend to take. They also cannot make repeated calls over a short period to annoy or harass you.

If you don't pay, the collection agency can sue you to try to collect the debt. The law regulates credit reporting and ensures that only business entities with a specific, legitimate purpose, and not members of the general public, can check your credit without written permission.
Banks, insurers, lenders, and utility companies may also pull a credit report if you've applied for credit or service with them. In some circ*mstances, government agencies may request your credit report without your permission.

Under the Fair Credit Reporting Act, a bank can obtain a consumer report if it has a "permissible purpose," which may include the following: Credit transactions. Review or collection of an account.
If you find an unauthorized or inaccurate hard inquiry, you can file a dispute letter and request that the bureau remove it from your report. The consumer credit bureaus must investigate dispute requests unless they determine your dispute is frivolous.
Never give out or confirm personal or sensitive financial information β such as your bank account, credit card, or full Social Security number β unless you know the company or person you are talking with is a real debt collector.
If you fail to make payments, creditors will try to recoup the funds you owe them. In some cases, they may take legal action and request a bank levy. This may freeze your bank account and give creditors the right to take the funds directly from it.
What are the illegal tactics of debt collectors?
A debt collector is also not allowed to harass, oppress, or abuse you or anyone else they contact. This includes repetitious phone calls with the intent to harass, use of obscene or profane language, and threats of violence or harm.
Debt relief or debt cancellation is the partial or total forgiveness of debt, or the slowing or stopping of debt growth, owed by individuals, corporations, or nations. From antiquity through the 19th century, it refers to domestic debts, in particular agricultural debts and freeing of debt slaves.
The debt trap is a situation where you've been forced to take on more borrowings in order to pay off your existing debts. Eventually, you're stuck in a situation where the debt spirals out of control and exceeds your capacity to pay it off.
A charge-off can lower your credit score by 50 to 150 points and can also look very bad on your credit report. It signals to potential lenders that you could skip out on your debt obligations for extended periods of time.
By paying the collection agency directly, the notification of the debt could stay on your credit report longer than if you attempt to use another option, like filing for bankruptcy. When institutions check your credit report and see this information on it, it may harm your ability to obtain loans.
